New Mexico Auto Insurance Guide

New Mexico auto insurance requirements are summed up simply by saying that you must prove yourself financially responsible in the event of an accident. There are two methods of providing proof of financial responsibility, the most common of which is to purchase a liability insurance policy for your automobile(s). The other method for proving responsibility is to deposit at least $60,000 with the state treasurer's office as a surety bond which would be forfeit to pay any debts owed by you in the event of an accident in which you are found to be at fault.

In addition to the fairly light requirements for proving financial responsibility in New Mexico, the penalties for noncompliance can also seem fairly light compared to that of other states. If you are stopped by an officer and you cannot provide proof of insurance, you will need to bring proof of insurance on that date to your court appointment. If you were driving without insurance and stopped, you will lose your vehicle registration and be charged with a misdemeanor which carries a fine of around $300.

New Mexico uses the Insurance Identification Database (IIDB) as a method of working with insurance companies to receive notice when you cancel a policy or allow it to lapse. The state will then send you notice that you need to either verify that you are no longer driving or that you have other coverage.

Mandatory Minimum Coverage in New Mexico

For liability insurance requirements in New Mexico, one only needs to secure a policy that meets the following minimums:

  • $20,000 - liability insurance for an accident resulting in the injury or death of any one person.
  • $50,000 - liability insurance for an accident resulting in the injury or death of any number of persons over one.
  • $10,000 - liability insurance for damage to property as a result of an accident.

The generosity of New Mexico in allowing for these low limits means that many are often caught unawares by the high cost of an accident they are found to be at fault for. The medical expenses for one person can easily surpass $20,000; especially if there is an ambulance or airlift required. Once your insurance coverage amounts have been exhausted, you will be personally responsible for any unpaid amount.

Motorcycle Coverage Requirements

The motorcycle insurance requirements in New Mexico are identical to those for a regular vehicle. Either purchase an insurance policy with the 20/50/10 coverage or secure a bond with the State Treasurer's office for $60,000 or more.
